This book explores the question of how international law is applied by domestic courts. Through case studies and analysis the contributors consider how traditions and diversity affect the interpretation of international law, from a mixture of doctrinal, practical, and theoretical approaches.

The role of subnational regions is ill-conceived in international law scholarship, which has come to slowly accept the important role that cities can play as international actors. Opening up the academic debate for a perspective on regions promises to develop new insights on the divide of governance functions between international organizations and states, regions and cities. At the same time, the regional focus helps to unearth some of the shortcomings of overly enthusiastic approaches to what cities can do as global (...) actors. International law scholarship has found it difficult, however, to engage with the concept of the region. This is owed, as this Article demonstrates, to difficult definitional issues as well as the informalizing bend of a focus on regional governance, which is hard to square with traditions of formalist thinking in international law. Ultimately, the Article argues that regions can function as a useful prism through which to analyze current governance challenges. (shrink)

This paper argues that essential features of Feyerabend's philosophy, namely his radicalization of critical rationalism and his turn to relativism, could be understood better in the light of his engagement with early Greek thought. In contrast to his earlier, Popperian views he came to see the Homeric worldview as a genuine alternative, which was not falsified by the Presocratics. Unlike socio–psychological and externalist accounts my reading of his published and unpublished material suggests that his alternative reconstruction of the ancient beginnings (...) of the Western scientific tradition motivate and justify his moderate Protagorean relativism. A comparison of attitudes among managers from France, Germany and the United States is made with respect to codes of ethics and ethical business philosophy. Findings are also compared with past studies by Baumhart and by Brenner and Molander where data are available. While the current data appear to be consistent with the past studies, there appear to be differences in attitudes among the managers from the three countries.

IN THIS ESSAY WE ARGUE FOR A RECONFIGURATION OF JUST WAR THEORY around the principle of just intention. A just intention—based just war theory can overcome problems inherent in two alternative "ideal-typical" accounts of just war theory. The "internationalist" account argues for the promotion of justice, by analogy to its pursuit in domestic politics. The "realist" account, on the other hand, favors the particular manifestations of justice within states. Taken together, these two accounts complement each other and emphasize genuine goods. (...) The possibility of taken them together, however, arises only out of consideration of just war theory as a peacemaking activity, ordered to the end, or intention, of this political act. Driven by the question, 'What is the computational content of a (formal) proof?', this book studies fundamental interactions between proof theory and computability. It provides a unique self-contained text for advanced students and researchers in mathematical logic and computer science. Part I covers basic proof theory, computability and Gödel's theorems. Part II studies and classifies provable recursion in classical systems, from fragments of Peano arithmetic up to Π11-CA0. Ordinal analysis and the (Schwichtenberg-Wainer) subrecursive hierarchies play a central role and are (...) used in proving the 'modified finite Ramsey' and 'extended Kruskal' independence results for PA and Π11-CA0. Part III develops the theoretical underpinnings of the first author's proof assistant MINLOG. Longtemps considéré comme de « piètre fiabilité » par rapport au récit parallèle des livres de Samuel et des Rois, ces livres apparaissent aussi sans originalité littéraire par rapport notamment à l'art consommé des récits des livres de Samuel. Dans le sillage de l'Art du récit biblique, de Robert Alter, Ph. Abadie tente de faire ressortir la richesse et la variété des procédés d'écriture qui font du (...) livre des Chroniques une œuvre littéraire véritable. Celle-ci tient fondamentalement à un projet global que révèlent et confirment des « unités kérygmatiques » structurantes et l'ordonnancement de grands ensembles selon divers procédés : technique de répétition et système de périodisation chronologique notamment.It is still paradoxical to recognize the statute of literary work for the books of Chronicles. Long time considered as of “poor reliability” in comparison with the parallel history of the books of Samuel and Kings, these books also seem to be without literary originality in comparison with, notably, the consummate art of the narratives in the books of Samuel. In the wake of “The Art of Biblical Narrative” by Robert Alter, Ph. Abadie tries to bring out the richness and the variety of the writing procedures that make the book of Chronicles a truly literary work. It fundamentally holds to a global project that reveals and confirms some “kerygmatic unities,” structuring and ordering great ensembles according to diverse procedures: especially a technique of repetition and system of chronological periodisation. La relation entre la philosophie et la mystique forme une question " à la limite ", que la fatalité a le plus souvent déclinée en une suite d'oppositions frontales : entre le rationnel et l'émotionnel, le logique et le pathologique, le discours et l'indicible... Depuis quelques années cependant, plusieurs motifs portent à reconsidérer cette relation singulière. Une somme d'informations sans précédent sur les diverses traditions mystiques, sur leurs variabilités historiques et géographiques est désormais accessible. En outre, la mystique est devenue (...) un objet œcuménique et interreligieux de premier plan qui invite à reposer la question de l'essence du religieux dans la traversée herméneutique des différences confessionnelles. Enfin, on enregistre une forte demande de redressement spéculatif face à l'essor actuel des sectes et au développement des syncrétismes religieux. Mais le philosophe est-il qualifié pour comprendre la mystique? A quelles conditions? De son côté, le mystique n'a-t-il point tendance à cacher sa dette à l'égard de l'expérience de la pensée, voire des concepts philosophiques? Plus profondément encore, faut-il lier la mystique au seul " religieux "? La philosophie n'est-elle pas un exercice spirituel, une expérience? C'est justement par cette entrée " expérientielle " dans la question que le présent ouvrage trouve son originalité. The white‐rot fungus Phanrochaete chrysosporium has the ability to degrade a wide variety of structurally diverse organic compounds, including a number of environmentally persistent organopollutants. The unique biodegradative abilities of this fungus appears to be dependent upon its lignin‐degrading system. The non‐specific and partially extracellular nature of this system suggests that it may be useful as a supplementary means to treat organochemical wastes.

William Alston’s argument against the deontological conception of epistemic justification is a classic—and much debated—piece of contemporary epistemology. At the heart of Alston’s argument, however, lies a very simple mistake which, surprisingly, appears to have gone unnoticed in the vast literature now devoted to the argument. After having shown why some of the standard responses to Alston’s argument don’t work, we elucidate the mistake and offer a hypothesis as to why it has escaped attention.

The paper develops an objection to the extensional model of time consciousness—the view that temporally extended events or processes, and their temporal properties, can be directly perceived as such. Importantly, following James, advocates of the extensional model typically insist that whole experiences of temporal relations between non-simultaneous events are distinct from mere successions of their temporal parts. This means, presumably, that there ought to be some feature(s) differentiating the former from the latter. Johannes von Kries’s Spielraum-theory is regarded as one of the most important philosophical contributions of the nineteenth century to an objective interpretation of probability. This paper aims at a critical and contextual analysis of von Kries’s approach: It is contextual insofar as it reconstructs the Spielraum-theory in the historical setting that formed his scientific and philosophical outlook. It is critical insofar as it unfolds systematic tensions and inconsistencies which are rooted in this context, especially in the grave change of mechanism (...) which took place in the late nineteenth century. In this regard, the paper focuses on von Kries’s understanding of natural laws and nomological knowledge in relation to his concept of objective probability. While the formal approach of the Spielraum-theory—as far as developed by von Kries—seems sound, his epistemological claims with respect to nomological knowledge sustain classical mechanism and are hence difficult to substantiate from the point of view of modern science. We investigate interpolation properties of many-valued propositional logics related to continuous t-norms. In case of failure of interpolation, we characterize the minimal interpolating extensions of the languages. For finite-valued logics, we count the number of interpolating extensions by Fibonacci sequences.

Psychoanalysis sets out to solve the riddles and enigmas of the psyche. For Adorno, however, psychoanalysis itself is an enigma. Why, he asks, have both the theory and its therapeutic applications become entangled in insoluble contradictions? Adorno identifies to a certain extent with the great psychoanalytic riddle-solvers, Freud and Ferenczi, as he probes these contradictions. He hopes, however, to move beyond the limits of a theory that reduces all phenomena to psychological factors, so he also approaches the problem as a (...) sociologist. This perspective enables him to describe the static and dynamic aspects of the social structure within which psychoanalysis developed in the first half of the 20th century. And it frees him, furthermore, from the misconception that Freud passed on to most of his followers: the belief that they were pursuing a natural science of the soul, which would generate its own rigorously scientific psychological technique. Les conventions sont également mobilisées pour coordonner les individus d'un même groupe de travail, de façon à déterminer le moment et la durée de la pause, mais aussi leur niveau d'effort, comme " ne faire que x pièces à l'heure ", voire la façon dont ils sont rémunérés. Les conventions jouent ainsi un (...) rôle important dans la coordination économique. La notion de convention est un thème d'étude nouveau pour l'économie. Elle fait aujourd'hui l'objet de très nombreuses recherches. Cet ouvrage ambitionne de clarifier tous les usages du terme " convention " en économie, depuis les travaux qui s'appuient sur la philosophie du langage jusqu'aux thèses développées par " l'Economie des conventions ", en passant par la théorie des jeux. Several disputes about the nature of experience operate under the assumption that experiences have parts, including temporal parts. There's the widely held view, when it comes to temporal experiences, that we should follow James' exhortation that such experiences aren't mere successions of their temporal parts, but something more. And there's the question of whether it is the parts of experiences which determine whole experiences and the properties they have, or whether the determination goes instead from the whole to the parts, (...) as holists have it. But what are parts, or temporal parts, of experiences exactly—what does it mean to say that an experience is “part” of another? Are the participants in those disputes talking about the same thing—is there a univocal notion of “experiential part” available? Are there different kinds of experiential parts? And if there are, is there a systematic way of carving them out? More importantly, how should we conceive of the temporal parts of experiences, and how can we establish that experiences really do have temporal parts, against those who reject the notion? (shrink)

Der vorliegende interdisziplinäre Sammelband greift die Diskussion um sportpädagogische und sportpraktische Lösungsansätze auf. Er fragt nach den spezifischen ökologischen Problemen des Breitensports und nach den Konsequenzen, die aus ökologisch unverträglichen Sportentwicklungen für die Sportpädagogik und die Sportlehrer-Ausbildung zu ziehen sind. Ein weiterer Schwerpunkt liegt auf dem Thema Sport und Gesundheit. Dabei kommen vor allem die präventiven und rehabilitativen Wirkungen gesundheits- und naturbewussten Sporttreibens in den Blick. Abschliessend werden die (...) besondere Stellung und Aufgabe des Hochschulsports, seine ökologischen Herausforderungen und seine Bedeutung für die Bewältigung des Lebens- und Berufsalltags thematisiert. Die 22 Beiträge dieses Bandes begreifen Sprache als Fundamentalkategorie des Menschen. Alles Sprachliche ist nicht zeichentheoretisch zu verstehen, sondern als Ausdruck eines notwendigen Verhältnisses von Wort und Sache. Dies wird am Kritischen der Sprache selbst, am Sprachdenken und am Metaphorischen zu zeigen versucht. Wichtige Erscheinungen des deutschen Sprachdenkens werden vorgestellt. Die problematische Entwicklung des Sprachbegriffs seit dem 19. Jahrhundert erscheint im Tatsachenbegriff, in der Vorstellung der öffentlichen Rede und in der Tendenz zur Mediensprache. Die Stellung der bedeutenden Literatur innerhalb dieser (...) Sprachvorstellung wird ebenso erörtert wie die Mängel und Anpassungsversuche der Literaturwissenschaft in diesem Zusammenhang. Außerdem geht es um die Fragwürdigkeiten der Literaturkritik heute. Die Überlegung zum Sprechen in den Medien geht vom Typus des Journalisten einerseits wie von den zentralen Medienbegriffen, nämlich Nachricht und Meinung, andererseits aus. Kritische Betrachtungen des Umgangs der Medien mit der Metaphorik wie deren Tendenz auf Sprachbeherrschung werden ebenso behandelt wie die historische Medienkritik und Thesen zur sprachkritischen Ethik in den Medien. Die Arbeit von Karl Kraus als bisher wichtigstes Beispiel einer sprachlichen Medienkritik wird dargestellt. Abschließend geht es um den Begriff der Interpretation als zentralen Begriff einer sprachorientierten Wissenschaft. (shrink)
